These terms govern the websites, automations, AI receptionist, AI integrations and social media services provided by ByRocket, operated by Jesse Kill, based in Wellington, New Zealand. By engaging any of our services you agree to these terms. Where we give you a separate written quote or plan, that quote and these terms are read together, and if they conflict, the written quote takes priority for that specific piece of work.
Our services and pricing
ByRocket provides digital services for New Zealand small businesses and trades. All prices are in New Zealand Dollars (NZD). Our current services are:
- Lift-off: $350/mo. A hand-built website plus the six-part automation system. No setup fee, no fixed-term contract.
- Holly, the AI receptionist: $3,000 set-up, then $300/mo maintenance. Call minutes billed at provider cost, or paid by you directly to the provider.
- Custom AI integrations: Connect from $6,000, Operate from $12,000, Stack from $20,000 (quoted per scope), then $300/mo AI Care maintenance. AI usage billed at provider cost, or paid by you directly.
- Daily Social: $600/mo social media management.
- Social + Drone Day: $1,000/mo, which includes one three-hour filming session per month.
- AI Website Chat: $750 set-up, then $75/mo.
- AI Business Setup: $750 one-off.
We are not currently GST registered. When GST registration applies, prices may be adjusted and you will be told in advance. Custom work outside these standard offerings is confirmed in a written quote before any work begins.
Lift-off plan
Lift-off is $350/mo and includes a hand-built website plus six automations that run your front-of-house:
- Instant lead follow-up
- Missed-call text-back
- Review funnel
- One-click campaigns
- On-site SEO
- Hosting, management and updates of the site and automations
There is no setup fee and no fixed term. You can cancel at any time and your plan runs to the end of the current paid month.
If you cancel Lift-off, you keep your website. On cancellation we hand over your site files and code so you can host it elsewhere. What ends is the hosting, the ongoing management, and the six automations, as those are the service you were paying the monthly fee for. Your website itself is yours to keep.
Holly, the AI receptionist
Holly is an AI phone receptionist built on third-party platforms (currently Vapi for orchestration and Telnyx for telephony, plus a voice and language model provider). Holly is set up for inbound calls to your business.
What you pay
- $3,000 set-up: a one-off fee to build and configure Holly for your business. Once this is paid, the receptionist we build is yours. You own the setup.
- $300/mo maintenance: an optional ongoing service where we keep Holly tuned to your business rules, monitor how she is performing, and make adjustments as your needs change.
- Call minutes at cost: the phone and platform usage is billed to you at the provider's actual cost with no ByRocket margin, or you run Holly on your own provider accounts and pay the providers directly. We do not make a margin on your call volume.
Call recording
Holly records and transcribes calls so the conversations can be reviewed. For your own Holly, recordings and transcripts are stored in the connected platform (Vapi) and are available to you on your dashboard. You are responsible for making sure callers to your business are informed that calls may be recorded, in line with your obligations under New Zealand law and the Privacy Act 2020. See our Privacy Policy for how call data is handled.
If you cancel maintenance
You keep Holly. You paid the $3,000 set-up outright, so the receptionist remains yours and can keep running. What ends is the $300/mo service: we stop tuning, monitoring and adjusting her for you. Running Holly after that, including the platform accounts and call costs, becomes your responsibility.
Custom AI integrations
Custom AI integrations connect an AI assistant to the software your business already runs on, such as Xero, Tradify, ServiceM8 or Fergus. We build these in three tiers:
- Connect (from $6,000): one system, read-only. The AI can answer questions and pull reports.
- Operate (from $12,000): one system, where the AI can take actions such as drafting quotes, raising invoices, creating jobs or updating records, with approval controls.
- Stack (from $20,000, quoted per scope): multiple systems, with authentication, hosting and monitoring.
What you pay
- The build fee is a one-off. Once paid, the integration we build is yours. You own the connector.
- $300/mo AI Care: an optional maintenance service (updates, monitoring, fixes). This is separate from usage and is not a usage allowance.
- AI usage at cost: the AI provider usage (tokens) is billed to you at the provider's actual cost with no ByRocket margin, or you run the integration on your own provider keys and pay directly. Usage is not bundled into the $300/mo.
Approvals and actions
For Operate and Stack tiers, where the AI can take actions inside your systems, those actions run through approval controls that you configure and review. You remain responsible for reviewing and approving what the AI does in your business. ByRocket is not liable for the outcome of an action that the AI took and that you or your team approved, or that ran under approval settings you chose.
If you cancel AI Care
You keep the integration. The connector remains yours. What ends is our maintenance and monitoring. Running it after that, including hosting and AI usage costs, becomes your responsibility.
Daily Social and Social + Drone Day
Daily Social ($600/mo): ongoing social media content and management for your business. To deliver this we need access to the relevant social accounts, or permission to post on your behalf. You remain the owner of your social accounts and your audience.
Social + Drone Day ($1,000/mo): Daily Social plus one filming session of up to three hours per calendar month, which may include drone footage.
- Use it or lose it: the monthly session does not stack or roll over. If a session is not used or booked within the month, it is not carried into the next month and is not refunded.
- Drone and airspace rules: all drone filming is carried out in line with Civil Aviation Authority rules. Some locations, altitudes or airspace require consent or are not permitted, and we may not be able to capture a shot where the rules or conditions do not allow it. Safety and legal compliance come first.
- Footage and photos: the final edited photos and videos we deliver are yours to use for your business. We may keep and use the footage and finished work in our own portfolio and marketing unless you ask us not to in writing. Raw and unused footage remains with ByRocket unless agreed otherwise in writing.
Social plans are month-to-month. You can cancel at any time, and the plan runs to the end of the current paid month.
How it works
Our standard process is:
- 1. Enquiry: you submit your details via our website form.
- 2. Call and intake: we run a short call and gather your details and preferences.
- 3. Build: we design and build your website and wire up the automations or services, typically within 7 to 10 business days for a standard Lift-off site. Larger builds such as AI integrations are scheduled and estimated separately.
- 4. Launch: we walk you through it, go live, and hand over access.
- 5. Ongoing: your monthly plan keeps the relevant service hosted, managed and running.
Payment terms
Monthly plans are billed in advance each cycle. Payments are processed securely through Stripe, and your card details are handled entirely by Stripe and never stored on our servers.
One-off fees, such as a Holly set-up or an AI integration build, are quoted and invoiced separately and confirmed before work begins. For larger builds we may invoice a deposit up front and the balance on delivery, as set out in your quote.
Usage billed at cost: where a service involves third-party usage that we bill at cost (such as Holly call minutes or AI integration usage), that usage is passed on to you at the provider's actual cost with no ByRocket margin, or you pay the provider directly on your own accounts. Provider prices are set by those providers and can change.
Revisions and scope
Your website build includes a round of revisions on the brand direction and a review round on the initial build. A "revision" means changes to the existing design direction, such as colour adjustments, text changes or layout tweaks. It does not include a complete redesign or significant change of scope.
Additional revisions, new pages, or scope changes beyond what is included may incur extra charges, which will be communicated and agreed before any additional work begins.
Intellectual property
Your content: you retain full ownership of all content you provide, including text, images, logos and branding.
Your website and builds: once the relevant fee is paid, the website, receptionist or integration we build for you is yours. On request, or on cancellation, we hand over the files and code so you can host or transfer them.
Portfolio rights: we may display your completed website, finished social content and case studies in our own portfolio and marketing, unless you ask us not to in writing.
Third-party assets and tools: stock images, fonts, and third-party platforms (such as Vapi, Telnyx, Stripe, and the AI providers) are subject to their own licences and terms. We use assets that are properly licensed for your use, and your use of the connected platforms is also subject to those platforms' terms.
Cancellation, and what you keep
All monthly plans are no lock-in. You can cancel at any time, and your plan runs to the end of the current paid month. Monthly fees already paid for the current cycle are non-refundable, as the service has been provided for that period. Here is what you keep in each case:
- Lift-off: you keep your website (files and code handed over). You lose the hosting, ongoing management and the six automations.
- Holly maintenance: you keep Holly (you paid the set-up outright). You lose our tuning and monitoring, and running Holly and her call costs become yours.
- AI Care: you keep the integration. You lose our maintenance and monitoring, and hosting and AI usage costs become yours.
- Daily Social / Social + Drone Day: you keep the content already delivered and your accounts. Ongoing content, management and any unused monthly session end.
Any refunds that do apply are processed back to the original payment method via Stripe.
Consumer guarantees
Under the New Zealand Consumer Guarantees Act 1993, our services come with guarantees that cannot be excluded. These include that services will be carried out with reasonable care and skill, will be fit for the purpose communicated to us, and will be completed within a reasonable time.
If our services do not meet these guarantees, you may be entitled to a remedy. Nothing in these terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
Limitation of liability
To the maximum extent permitted by New Zealand law:
- Our total liability for any claim arising from our services is limited to the amount you paid us for those services.
- We are not liable for any indirect, consequential or incidental damages, including loss of revenue, data or business opportunities.
- We are not responsible for downtime, outages, price changes or issues caused by third-party platforms (such as your hosting provider, domain registrar, Stripe, Vapi, Telnyx, the AI providers, or social media platforms), or by your own accounts and settings after handover.
- For AI receptionist and AI integration services, the AI can make mistakes. We are not liable for the content of an AI-generated response, or for an action the AI took that you or your team approved or that ran under settings you configured. You are responsible for reviewing AI output and actions in your business.
This limitation does not apply to any rights you have under the Consumer Guarantees Act 1993 that cannot be excluded by law.
Your responsibilities
So we can deliver your project on time and to a high standard, you agree to:
- Provide accurate and complete information during intake and onboarding.
- Respond to communications and review requests in a timely manner.
- Ensure any content, images or materials you provide do not infringe third-party rights.
- Where a service needs it, give us the access we need to your accounts (such as social accounts or business software) and keep that access valid.
- For Holly, make sure callers to your business are appropriately informed that calls may be recorded.
- For AI integrations, review and approve AI actions in your systems and set approval controls appropriate to your business.
- Not use anything we build for any unlawful purpose.
Delays in providing feedback, content or access may extend the project timeline beyond the estimate.
Dispute resolution
If a dispute arises, please contact us first at [email protected] so we can try to resolve it directly.
If we cannot reach a resolution, either party may refer the matter to mediation. If mediation is unsuccessful, the dispute will be subject to the exclusive jurisdiction of the New Zealand courts. These terms are governed by the laws of New Zealand.
Changes to these terms
We may update these terms from time to time as our services change. Any changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
