Terms & Conditions

These terms govern the web design services provided by ByRocket, operated by Jesse Kill, based in Wellington, New Zealand. By engaging our services, you agree to these terms.

ByRocket provides custom website design and development services. Our standard offering includes:

  • Website Build (Launch): $250 NZD one-time payment for a custom-designed, hand-coded website of up to 8 pages. The exact number of pages will be agreed upon before the build begins
  • Maintenance: $250 NZD per month (optional), covering content updates, monitoring, backups, and security patches

Prices are in New Zealand Dollars. We are not currently GST registered. When GST registration applies, prices may be adjusted accordingly and you will be notified in advance.

Custom quotes may be provided for projects outside our standard offering. Any custom pricing will be confirmed in writing before work begins.

Our standard process is as follows:

  • 1. Enquiry: you submit your details via our website form
  • 2. Intake: our design team sends you a questionnaire to gather project details, preferences, and inspiration
  • 3. Brand concept: we create a brand direction document for your review. You may request up to 3 revisions on the brand concept
  • 4. Payment: once the brand concept is approved, we send a payment link. Full payment of $250 NZD is required before the build begins
  • 5. Build: we design and develop your website within 5 to 7 business days
  • 6. Review: you review the completed site. One round of revisions is included
  • 7. Launch: once approved, we deploy your site and hand over access

Payment is processed securely through Stripe. Full payment is due before the website build phase begins.

We accept all major credit and debit cards via Stripe. Your card details are handled entirely by Stripe and are never stored on our servers.

No deposit is required during the enquiry, intake, or brand concept phases.

Our standard package includes:

  • Brand concept: up to 3 revisions before approval
  • Website review: 1 round of revisions after the initial build

A "revision" means changes to the existing design direction, such as colour adjustments, text changes, or layout tweaks. It does not include a complete redesign or significant scope changes.

Additional revisions or scope changes beyond what is included may incur extra charges, which will be communicated and agreed upon before any additional work begins.

Your content: you retain full ownership of all content you provide, including text, images, logos, and branding materials.

Completed website: upon full payment, you own the final website files and code delivered to you. You are free to host, modify, or transfer your site as you see fit.

Portfolio rights: we reserve the right to display your completed website in our portfolio, case studies, and marketing materials unless you request otherwise in writing.

Third-party assets: any stock images, fonts, or third-party tools used in your project will be subject to their respective licences. We will ensure all assets used are properly licensed for your use.

Before payment: you may cancel your project at any time before making payment, at no cost.

After payment, before build starts: if you cancel after payment but before the build phase has begun, a full refund will be issued.

During the build: if you cancel during the build phase, a partial refund may be offered at our discretion, based on the work already completed.

After delivery: once the completed website has been delivered and approved, no refunds will be issued.

All refunds will be processed back to the original payment method via Stripe.

Under the New Zealand Consumer Guarantees Act 1993, our services come with guarantees that cannot be excluded. These include that services will be carried out with reasonable care and skill, services will be fit for the purpose communicated to us, and services will be completed within a reasonable time.

If our services do not meet these guarantees, you may be entitled to a remedy. Nothing in these terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

To the maximum extent permitted by New Zealand law:

  • Our total liability for any claim arising from our services is limited to the amount you paid for those services
  • We are not liable for any indirect, consequential, or incidental damages, including loss of revenue, data, or business opportunities
  • We are not responsible for any downtime, data loss, or issues caused by your hosting provider, domain registrar, or third-party services after handover

This limitation does not apply to any rights you have under the Consumer Guarantees Act 1993 that cannot be excluded by law.

To ensure we can deliver your project on time and to a high standard, you agree to:

  • Provide accurate and complete information during the intake process
  • Respond to communications and review requests in a timely manner
  • Ensure any content, images, or materials you provide do not infringe on any third-party intellectual property rights
  • Not use the website we build for any unlawful purpose

Delays in providing feedback or content may extend the project timeline beyond the estimated 5 to 7 business days.

If a dispute arises, we encourage you to contact us first at [email protected] so we can try to resolve it directly.

If we cannot reach a resolution, either party may refer the matter to mediation. If mediation is unsuccessful, the dispute will be subject to the exclusive jurisdiction of the New Zealand courts.

These terms are governed by the laws of New Zealand.

We may update these terms from time to time. Any changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
